ROZY RENTAL — TERMS OF SERVICE

Welcome to Rozy Rental.
These Terms of Service ("Terms") govern your access to and use of the Rozy Rental mobile application, website and related services.
By registering for, accessing, or using Rozy Rental, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.
1. About Rozy Rental
Rozy Rental is a platform that helps connect:
Property owners may publish available rooms/properties, while tenants may search listings and contact property owners.
Rozy Rental itself is not automatically a landlord, tenant, broker, real-estate agent, property manager, or party to any rental agreement between users. Any rental agreement is between the relevant property owner and tenant.
2. Eligibility
- You must provide accurate information when creating an account.
- You must use Rozy Rental only if you are legally permitted to enter into rental-related arrangements under applicable law.
- If you are not legally capable of entering into a rental agreement, you should not independently enter into such an agreement through the platform.
3. User Accounts
You may be required to create an account to use certain features. You agree to:
- Provide accurate information and keep it updated.
- Protect your login credentials and not share your account with another person.
- Not create accounts for fraudulent purposes.
- Notify us immediately if you suspect unauthorized access.
You are responsible for activity performed through your account unless caused by circumstances outside your reasonable control.
4. Property Listings & Verification
Property owners may create rental listings containing information such as property photos, room details, rent, deposit, amenities, location, availability, property rules, and description.
Property owners must ensure that their listings are accurate, lawful, current and not misleading.
Owners must NOT list:
- Property they have no authority to rent.
- Fake properties, non-existent rooms, or listings with incorrect utility meter / consumer details.
- Property belonging to another person without authorization.
- Misleading photographs or false rent/deposit information.
5. Listing Accuracy
Rozy Rental does not independently guarantee the accuracy of every listing. Property owners are responsible for the information they publish.
A listing being displayed on Rozy Rental does not mean that Rozy Rental has certified, verified, inspected, or guaranteed the property or owner, unless a specific verification badge or feature expressly states otherwise.
6. Tenant Responsibilities
Tenants should independently verify:
- Property location, condition, and availability.
- Owner identity, ownership, or authority to rent.
- Rent, security deposit, electricity/water charges, and maintenance fees.
- House rules, rental agreement, and any other applicable conditions.
Tenants should not rely solely on information displayed in a listing.
7. Contact, Announcements & Communications
Rozy Rental allows users to communicate, and property owners to broadcast announcements to tenants in specific buildings. Users must NOT use Rozy Rental to:
- Harass, threaten, or send abusive messages to others.
- Spam users, send fraudulent offers, or misuse the announcement broadcasting system.
- Collect information for unlawful purposes or impersonate another person.
8. Occupancy, Room Agreements & Paid Services
Rozy Rental may offer value-added paid features, such as the generation of digital Room Agreements between owners and tenants. Regarding paid services and agreements:
- Fees paid for digital agreement generation or premium features are governed by our commercial terms; refunds are subject to service availability and processing criteria.
- Digital agreements generated via the platform serve as a facilitation tool; users must ensure compliance with local legal requirements regarding stamp duty and registration for formal legal validity.
An occupancy request or digital draft does not by itself create a legally binding tenancy agreement until finalized and executed properly by both parties.
9. Tenant Billing & Bill Records
Property owners may generate digital rent bills, utility statements (electricity/water), and maintain billing histories for their tenants through the platform:
- Owners are solely responsible for entering accurate rent and utility consumption figures.
- Rozy Rental provides record-keeping tools as a convenience and does not act as a financial auditor or collection agency for disputed bills.
10. Verification Badge & Document Submission
Users and property owners may submit legal or identity documents to apply for a Platform Verification Badge:
- All submitted records, IDs, or property documents must be authentic, valid, and legally owned by the applicant.
- Submitting forged, tampered, or fraudulent documents will result in immediate account suspension, permanent property ban, and forfeiture of platform access.
11. Payments
Where Rozy Rental does not process rental payments directly, users should understand that:
Rozy Rental is not responsible for money transferred directly between owners and tenants.
Users should be extremely careful before sending advance rent, security deposits, occupancy-related fees, or brokerage payments.
12. Fraud and Scams
Users must not use Rozy Rental for fraudulent activities such as fake property listings, fake identities, fraudulent payment requests, or advance-payment scams. We may suspend or terminate accounts suspected of fraud or abuse.
13. Prohibited Content
Users must not upload content that is illegal, fraudulent, defamatory, contains malware, infringes copyright, violates privacy, or misrepresents a property.
14. User-Generated Content
Users retain ownership of content they submit. However, by submitting content, you grant Rozy Rental a worldwide, royalty-free license to host, store, display, and process that content as necessary to operate and promote the Service.
15. Intellectual Property
The Rozy Rental application, branding, logos, graphics, text, and software are owned by or licensed to Rozy Rental. You may not copy, reverse engineer, reproduce branding, scrape databases, or attempt unauthorized access.
16. User Verification & Liability Limits
Verification badges or features do not constitute an absolute guarantee that a user, property, listing, or transaction is completely safe or genuine. Rozy Rental provides a technology platform for connecting users and does not guarantee property availability, legal ownership, or tenant payment reliability.
17. Disputes Between Users
Any dispute between a property owner and tenant should initially be addressed between those parties. Rozy Rental does not act as an arbitrator or legal representative.
18. Account Suspension, Banning and Termination
We reserve the absolute right to suspend, restrict, or terminate user accounts or instantly ban/reject suspicious properties if a user violates these Terms, provides false/forged documents, engages in fraud, or creates platform security risks.
19. Service Availability
We aim to keep Rozy Rental available, but we do not guarantee uninterrupted operation due to maintenance, technical problems, or server issues.
20. Third-Party Services
Rozy Rental may integrate third-party services like Firebase, Google Maps, payment gateways, and cloud providers, which have their own terms and policies.
21. Privacy
Your use of Rozy Rental is also governed by our Privacy Policy, which forms an integral part of these Terms.
22. Changes to These Terms
We may update these Terms when necessary. Continued use of Rozy Rental after updated Terms are posted constitutes acceptance of the new Terms.
23. Governing Law
These Terms shall be governed by the applicable laws of India. Any disputes shall be subject to the jurisdiction of the appropriate courts in India.
